Terms & Conditions
General Terms and Conditions
1. Introductory provisions
1.1 In accordance with § 1751(1) of Act No. 89/2012 Coll. (Civil Code) as amended, the company Dušní 3 Concept, s.r.o. issues these terms and conditions, which form an integral part of the purchase contract concluded between:
Dušní 3 Concept, s.r.o., with registered office at Václavské náměstí 2132/47, 110 00 Praha 1, ID No.: 24794333, obchod@beostore.cz, tel. +420 727 915 597 (hereinafter the "seller") on one side and the buyer on the other.
1.2 The buyer is a natural or legal person who concludes a purchase contract with the seller through the seller's online store at www.bostore.cz (hereinafter the "e-shop").
1.3 If the buyer is a consumer under § 419 of Act 89/2012 Coll., relationships not governed by these terms shall be governed by Act No. 89/2012 Coll. If the buyer orders or purchases goods in the course of their business activity or independent professional practice, relationships not governed by these terms shall also be governed by Act No. 89/2012 Coll., with §§ 2158–2174 not applying.
1.4 By concluding the purchase contract, the buyer confirms that they have read the complete text of these terms, understand all provisions, and fully agree to them.
1.5 The seller is entitled to change these terms at any time. The buyer is bound by the version of the terms in effect at the time the purchase contract was concluded.
2. Conclusion of purchase contract
2.1 By selecting goods from the seller's offering and subsequently ordering them (by completing the order form), the buyer submits a proposal to conclude a purchase contract. The purchase contract is concluded at the moment the seller accepts this proposal by confirming the order sent to the buyer's email address. If no such confirmation is made, the contract is deemed not concluded.
2.2 The order form contains in particular the designation of goods, the price of goods, the method and cost of delivery, and a space for the buyer's identification details.
2.3 The buyer's identification details include their name and surname or company name, place of residence or registered office, date of birth or company ID number, email address, contact phone number, and any delivery address.
2.4 The price of all goods offered in the seller's e-shop is stated including VAT and all fees related to the sale (except for postage and packaging costs, which are stated separately). The price of goods is valid for the period during which it is published in the seller's e-shop.
2.5 A condition for the validity of the order is the completion of all required fields in the order form, including consent to these terms and conditions.
2.6 The buyer acknowledges that the seller is not obliged to conclude a purchase contract with the buyer for all goods listed in the e-shop — i.e. the display of goods in the seller's e-shop does not constitute an offer to conclude a contract within the meaning of § 1732 of the Civil Code.
2.7 All facts stated by the buyer in the notes section of the order form become part of the concluded purchase contract if the seller agrees to them. In case of disagreement, the contract is deemed not concluded. If the seller is unable to fulfil any buyer's request expressed in the order, the seller will send the buyer a revised order proposal. The contract is then concluded when the buyer sends the revised order and the seller subsequently confirms it.
2.8 The seller is entitled, in circumstances worthy of special attention, to request from the buyer telephone or written confirmation of their order before concluding the purchase contract.
2.9 Delivery time: Goods in stock are shipped immediately after payment by the selected carrier (Czech Post, DPD, personal collection). For goods on order, the delivery time will be communicated by email or phone. The maximum delivery time for goods not in stock is 20 working days.
3. Rights and obligations of parties
3.1 By concluding the purchase contract, the seller is obliged to deliver the ordered goods to the buyer, and the buyer is obliged to pay the agreed price to the seller.
3.2 The buyer is obliged to accept goods ordered and delivered in accordance with the purchase contract and these terms and conditions.
3.3 If it is necessary due to reasons on the buyer's side to deliver goods in a manner other than agreed in the contract, the seller is entitled to charge the buyer for all costs associated with such delivery.
4. Withdrawal from contract
4.1 In accordance with § 1829 of the Civil Code, the buyer has the right to withdraw from the purchase contract within 14 days of receiving the goods.
4.2 If the buyer withdraws from the contract, they shall send or hand over to the seller without undue delay, no later than fourteen days after withdrawal, the goods received from the seller.
4.3 If the buyer withdraws from the contract, the seller shall refund without undue delay, no later than fourteen days after withdrawal, all monetary funds including delivery costs received from the buyer (except for additional costs incurred due to the buyer's choice of a more expensive delivery method than the cheapest standard option offered).
4.4 If the buyer withdraws from the purchase contract, the seller is not obliged to refund the received funds before the buyer hands over the goods or proves that the goods have been sent to the seller.
4.5 Costs associated with returning the goods to the seller are borne in full by the buyer.
4.6 The buyer is liable to the seller for any reduction in the value of the goods resulting from handling the goods in a way other than necessary given their nature and characteristics.
4.7 The buyer may not withdraw from contracts listed in § 1837 of Act 89/2012 Coll.
4.8 The seller is entitled to withdraw from the purchase contract before the buyer takes possession of the goods in circumstances that prevent delivery of the ordered goods.
5. Payment terms
5.1 The buyer is not obliged to pay a deposit to the seller for ordered goods, except in cases expressly agreed upon in the order.
5.2 Goods will be delivered or handed over to the buyer only after full payment of the purchase price including delivery costs. The purchase price is due at the time of receiving the goods.
5.3 Ownership of the ordered goods transfers from the seller to the buyer only upon full payment of the purchase price including delivery costs.
5.4 The buyer expressly agrees to receiving the tax document in electronic form (instead of a paper document) at their email address.
6. Rights from defective performance
6.1 The rights and obligations of the contracting parties regarding defective performance are governed by Act No. 89/2012 Coll., specifically §§ 2099–2112.
6.2 If defective performance constitutes a material breach of contract, the buyer has the right to have the defect remedied by delivery of a new defect-free item or delivery of the missing item, or to receive a reasonable price reduction, or to withdraw from the contract.
6.3 If defective performance constitutes a non-material breach of contract, the buyer has the right to have the defect remedied or to receive a reasonable price reduction.
6.4 By providing a quality guarantee, the seller undertakes that the goods will remain fit for their usual purpose for a specified period or retain their usual properties.
6.5 The warranty period runs from the delivery of the goods to the buyer; if the goods were dispatched under the contract, it runs from the arrival of the goods at the destination.
7. Personal data protection
See the separate section Terms of Personal Data Protection.
8. Final provisions
8.1 All relationships not governed by these terms are subject to the relevant provisions of the Civil Code and other related legislation.
8.2 If any provision of these terms is found to be unlawful or invalid, this shall not affect the validity or effectiveness of the remaining provisions.
8.3 All agreements between the seller and the buyer contained in the purchase contract take precedence over the provisions of these terms with which they conflict.
